No Win No Fee

A No Win No Fee agreement, otherwise known as a Conditional Fee Arrangement (CFA), means you only pay our legal fees if your claim succeeds. If your claim does not succeed, you do not pay our solicitors’ fees for the work covered by the agreement.
This type of funding is designed to reduce financial barriers to bringing a claim, while ensuring you understand the real costs and risks involved from the outset.
How No Win No Fee works in practice
When you instruct Justizia Law under a No Win No Fee arrangement:
- No upfront solicitors’ fees are payable to start your claim.
- We assess the merits of your case before agreeing to act.
- You receive clear, written terms explaining how the arrangement works, including fees, risks, and potential outcomes.
- If your claim succeeds, fees are paid in accordance with the agreement. This may include recovery of costs from the other side and, where permitted, a success fee.
- If your claim is unsuccessful, our solicitors’ fees are not payable under the agreement.
Disbursements and other costs
Even where solicitor fees are covered by a No Win No Fee agreement, some claims involve disbursements and third-party costs such as Court fees, expert reports, or barrister fees.
In addition:
- In certain circumstances, a Court may order the losing party to pay some of the other side’s costs.
- These risks and how they are managed are explained to you before you decide whether to proceed.
We do not present No Win No Fee as “risk-free”. Instead, we focus on risk being identified, explained and managed properly.
Insurance for adverse costs
Where appropriate, we may recommend After the Event (ATE) insurance. This type of insurance is designed to protect you against the risk of having to pay the other side’s costs if a claim is unsuccessful.
If insurance is recommended:
- We explain what it covers;
- Whether a premium applies; and
- When (and if) it becomes payable.
You will not be committed to insurance without understanding how it works and whether it is suitable for your case.
High-volume and group claims
Justizia Law regularly handles high-volume consumer claims and, where appropriate, co-ordinated or group-based claims involving common legal or factual issues.
This approach can:
- Improve efficiency and consistency,
- Control costs, and
- Allow claims to be pursued that may not be viable on an individual basis.
Even where claims are progressed as part of a wider group, your claim remains your own, and funding arrangements are explained on an individual basis.
Risk transparency and fair communication
The term “No Win No Fee” can be misleading if not properly explained. While it removes the risk of paying our solicitors’ fees if your claim fails, no funding arrangement removes all risk entirely.
